The Agency Legal Services Branch provides practical and solution-focused advice across a broad spectrum of matters to support business areas, including employment, workforce, and industrial relations matters; corporate, commercial, procurement, and property matters; information law and privacy matters; and scheme compliance, investigations and integrity matters.

The Branch plays a key enabling function, including the identification and mitigation of legal risk for the NDIA and is seeking candidates to fill various vacancies in the following teams: 

• Integrity Agencies
• Scheme Compliance & Investigations
• Commercial Law

The EL2 Lawyer (Legal Stream) is an important team leadership position within the NDIA and will have authority and responsibility to resolve legal issues and risks across wide-ranging activities of substantial depth involving significant detail. The position will exercise a significant degree of independence and will use a high-level of decision-making and judgement. The role will be required to coordinate and assume responsibility for legal advice to highly complex or sensitive projects and work program outcomes across the functions that have strategic or operational significance to the Agency. 

Integrity Agencies Team
Specific responsibilities include, but are not limited to:

• Providing strategic legal advice and assistance relating to suspected misconduct, corruption and integrity issues arising under:
  • Public Interest Disclosure Act 2013
  • National Anti-Corruption Commission Act 2022
• Providing legal advice and support in relation to the Agency's obligation to act as a model litigant.

Scheme Compliance & Investigations Team
Specific responsibilities include, but are not limited to:

• Providing strategic legal advice and subject matter expertise on all relevant aspects of NDIS Act and Rules as well as a range of complex legal issues involving statutory interpretation and administrative law, fraud and compliance, criminal, evidence and procedural law.
• Providing legal advice and support in relation to integrity uplift measures such as payment compliance and debt recovery processes and managing judicial review applications in relation to related administrative decisions. 

Due to the nature of the work undertaken in Scheme Compliance & Investigations, possessing a Negative Vetting Level 1 (NV1) security clearance is considered advantageous.

Commercial Law Team
Specific responsibilities include, but are not limited to:

• A broad range of procurement activities, including contracts in support of procurement of ICT and other operational capabilities; commercial negotiations of legal issues; grants; intellectual property; the agency’s obligations under the Public Governance, Performance and Accountability Act 2013 (Cth).
• Complex commercial law issues such as contracting, funding agreements, IP, insurance, and risk management.
• Statutory compliance and relevant Commonwealth laws and policies (e.g. Public Governance, Performance and Accountability Act 2013 (Cth), Commonwealth Procurement Rules).
• Drafting, reviewing and negotiating legal issues relating to commercial agreements (e.g. procurement, grants, leasing).
• Property law.

Mandatory qualifications 
This position is within the Legal stream and the candidate must possess relevant academic qualifications with admission as a legal practitioner, however described, of the High Court or the Supreme Court of an Australian State or Territory; and hold, or be able to obtain, a practising certificate (for WA applicants this must be an unrestricted practicing certificate). You must have proven experience in the relevant areas of law.

While this role is ideally performed from ACT - Deakin; NSW - Parramatta; NSW - Surry Hills; QLD - Brisbane; QLD - Robina; SA - Adelaide; VIC - Geelong; VIC - Richmond; WA - Midland, remote working arrangements may be considered. We intend to fill this role in an ongoing capacity, however non-ongoing roles up to 12 months with the possibility of extension up to 2 years may be offered.

Successful candidates will be required to undergo a pre-employment National Police History check, Worker Screening check and/or Working with Children Check (where required) and provide evidence of Australian Citizenship and must be able to obtain and maintain a Baseline security clearance, or hold a current security clearance of an appropriate level.
